Work Accident Claims
It is an employer’s duty to ensure you’re kept from harm while at work. Unfortunately, some industries are more dangerous than others, meaning accidents sometimes cannot be avoided. However, if you have been injured in an accident that was caused by an employer’s mistake or negligence, you could be entitled to compensation.
You need not be afraid of making a claim against your employer as by law they should have insurance to cover such incidents. In most cases we have worked on, the employer has encouraged a claim to be made.
Due to the variety of tasks carried out in different jobs and different sectors, it can be difficult to determine a comprehensive list of accidents that take place. However, the most common accidents leading to claims include:
- Armed forces claims
- Construction accidents;
- electrical hazards;
- exposure to harmful substances;
- factory accidents;
- falls at work;
- farming accidents;
- forklift truck accidents;
- inadequate or no training;
- industrial accidents;
- machinery failures;
- manual handling
- repetitive motion injuries;
- scaffolding accidents
- self-employed accident claims
- slips, trips and falls;
- vehicle incidents;
- warehouse accidents.
An employer’s duty
In the UK, all employers must adhere to legislation laid out by the Health and Safety Executive (HSE) to carry out risk assessments to prevent accidents from happening. This includes providing safety equipment for certain tasks, displaying warning signs in relevant areas, keeping workstations and floors clean and tidy, and providing appropriate training on all potentially dangerous tasks.
If your accident was caused by a failure to comply to HSE guidelines, or by the negligence of someone else, you could be entitled to make a claim for compensation.
